Personal Jurisdiction
Challenging the Court’s Personal Jurisdiction for Foreclosure
Jurisdiction over a person is the right of a court to take legal action against an individual. If the court does not have personal jurisdiction in a foreclosure case, it may not take any action against you. This includes foreclosing on your mortgage.
We may move to dismiss a foreclosure for lack of personal jurisdiction if the notice of complaint and/or other required documents were not served on you according to Illinois law. If the sheriff or process server did not hand the foreclosure notice to you in person, you have suffered a lack of service. This means the court does not have personal jurisdiction over you and cannot act on the foreclosure.
If you are facing foreclosure, you may think that there is nothing you can do. Don’t assume that you are powerless.
At EV Has, LLC, we are known for taking cases other law firms cannot resolve. We provide a more sophisticated approach to foreclosure defense by challenging the bank’s or lien holder’s right to foreclose. Let us review your case to see if it meets our criteria.
